These Terms of Service and End User License Agreement ("Terms") govern your access to and use of https://aqyanoos.com/, our mobile applications, web applications, online software, courses, tutorials, articles, guides, and other products and services that we develop, publish, or provide.
Aqyanoos is a software company based in Belgium. Our products and content focus on computers, smartphones, web development, software engineering, technology, and related educational topics.
"Aqyanoos," "we," "us," and "our" refer to Aqyanoos and, where applicable, its legal operating entity. "You" and "your" refer to any person who accesses or uses our services.
Legal operator: S. A. Khalil Kazimi
By accessing or using our services, you agree to these Terms to the extent permitted by applicable law. If you do not agree, you must stop using the affected service.
Specific products may have additional terms. Where additional terms apply, they govern the particular product, feature, or transaction they address, unless applicable law requires otherwise.
2. Eligibility and International Availability
Aqyanoos aims to make useful software and educational content available to people in different countries, backgrounds, and age groups.
You may use our services only if you are legally permitted to do so under the laws applicable to you and can comply with these Terms.
Certain account features, purchases, or services may have minimum age requirements. If you are under the age required to enter into a binding agreement in your jurisdiction, you must obtain any permission or supervision required by law.
Although our services are intended for an international audience, a particular product may not be available in every country, on every device, or through every app store. Local laws, technical restrictions, and third-party platform requirements may apply.
3. Our Services
Aqyanoos may develop, publish, or provide:
- Mobile applications for smartphones and supported devices.
- Web applications and browser-based software.
- Online tools and utilities.
- Courses, tutorials, articles, guides, and educational materials.
- Programming, software engineering, and technology resources.
- Software updates, new features, and additional digital products.
Features, availability, and technical requirements may differ between products. We may introduce, improve, modify, suspend, or discontinue features for legitimate operational, technical, security, or legal reasons, subject to applicable contractual commitments and mandatory legal rights.
4. User Accounts
Certain services require an account. When registering, you agree to provide accurate information and keep it reasonably up to date.
Depending on the service, you may provide your name, email address, phone number, country, preferred language, marital status, and other optional profile information.
You are responsible for:
- Providing accurate information where required.
- Keeping your login credentials confidential.
- Taking reasonable steps to prevent unauthorized account access.
- Notifying us if you suspect unauthorized use of your account.
- Using your account lawfully and in accordance with these Terms.
You must not impersonate another person, provide fraudulent information, or access another person's account without authorization.
We may restrict or suspend accounts where reasonably necessary to address security risks, unlawful activity, serious violations of these Terms, or other legitimate operational concerns. Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue.
5. End User License Agreement (EULA)
5.1. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the relevant Aqyanoos software for its intended purposes.
The license permits personal use or, where expressly allowed by a particular product, internal business or professional use. Commercial exploitation, redistribution, sublicensing, or other use outside the permitted license requires our prior written permission unless applicable law provides otherwise.
This license applies only to software that we own or are authorized to license. Third-party components may be governed by separate license terms.
5.2. Ownership and Intellectual Property
Unless expressly stated otherwise, Aqyanoos or its licensors retain all rights, title, and interest in our software, source code, designs, interfaces, branding, documentation, graphics, articles, tutorials, courses, and other original materials, including applicable intellectual property rights.
These Terms do not transfer ownership of our intellectual property to you. You receive only the rights expressly granted under these Terms or required by applicable law.
Third-party names, logos, trademarks, and other identifying marks remain the property of their respective owners.
5.3. License Restrictions
Unless authorized by us or permitted by applicable law, you must not:
- Copy, reproduce, distribute, sell, rent, lease, or sublicense our software outside the permitted license.
- Modify, adapt, translate, or create derivative works of our software where not authorized.
- Reverse engineer, decompile, or disassemble software, except where applicable law permits such activity notwithstanding this restriction.
- Remove copyright notices, trademarks, or proprietary notices.
- Bypass security controls, licensing mechanisms, or access restrictions.
- Use our software to develop or operate an unlawful service.
- Overload, disrupt, or interfere with our systems using automated or other means.
- Redistribute our applications or software under our name without permission.
Nothing in this section restricts rights that cannot lawfully be excluded, including applicable statutory rights relating to interoperability or lawful reverse engineering.
5.4. Installation, Updates, and Compatibility
Some applications require a compatible device, operating system, browser, internet connection, or third-party platform. Unless a particular agreement states otherwise, you are responsible for maintaining compatible equipment and connectivity.
We may provide updates, patches, security fixes, improvements, or new versions. We will comply with applicable legal obligations regarding updates and digital products.
We do not guarantee that every product will work on every device, operating system, browser, or configuration.
5.5. Open-Source and Third-Party Components
Software may include open-source libraries or other third-party components governed by separate licenses. Those licenses apply to the relevant components and prevail over these Terms to the extent of any conflict concerning those components.
6. Acceptable Use
You agree to use our services responsibly and lawfully. You must not use them to:
- Violate applicable laws or the rights of others.
- Engage in fraud, impersonation, harassment, threats, or abuse.
- Distribute malware, viruses, or harmful code.
- Gain unauthorized access to accounts, networks, systems, or data.
- Interfere with the availability, integrity, or security of our services.
- Attempt to access private information belonging to other users.
- Exploit vulnerabilities maliciously or conduct unauthorized attacks.
- Infringe intellectual property, privacy, or other legal rights.
- Misuse accounts or attempt to circumvent legitimate access restrictions.
- Materially disrupt our operations or harm other users.
We may investigate suspected violations and take proportionate action, including restricting access, suspending accounts, or reporting conduct to relevant authorities when legally justified.
7. User Content and Saved Application Data
Some applications allow you to enter information, create content, configure tools, or save your work.
Where a Save button is provided, information is intended to be stored for future access when you are logged in and actively choose to save it, according to the application's functionality.
Information that is not saved is intended to remain temporary and to be discarded when the browser is closed or the relevant session ends. Temporary information may be lost earlier due to technical issues.
You are responsible for saving information you need to retain. Do not rely on unsaved information being recoverable.
You retain any ownership rights you have in original content you provide, subject to third-party rights and applicable law. You authorize us to host, process, reproduce, and transmit that content only to the extent reasonably necessary to operate the relevant service, fulfill your requests, maintain security, and comply with applicable legal obligations.
We do not intentionally make your private profile information or privately saved application data publicly available. Your use of our services does not grant other users a general right to access that information.
8. Educational Content
Aqyanoos publishes courses, tutorials, articles, guides, and other educational materials relating to computers, smartphones, programming, web development, software engineering, and technology.
Unless expressly stated otherwise, educational content is provided for general informational and educational purposes. It is not a substitute for professional advice tailored to your circumstances.
Technology changes frequently. We aim to provide useful and accurate information, but we cannot guarantee that every article, code example, instruction, or tutorial will remain current, complete, error-free, or compatible with every environment.
You are responsible for evaluating the suitability of educational materials before applying them, particularly when working with production systems, sensitive information, cybersecurity, or important data.
9. Website Analytics and Advertising
Our website uses Google Analytics to measure visitor traffic, understand how visitors interact with our pages, and improve our website and content.
We also use Google Ads or related Google advertising services to display advertisements and, depending on the configuration, measure advertising performance or support advertising features.
These services may use cookies, online identifiers, and technical information as described in our Privacy Policy. Where required by applicable law, non-essential analytics and advertising technologies will be activated only after valid consent has been obtained.
You can manage your cookie choices through our website's cookie settings, where provided. Further information about the information we process, third-party providers, and your privacy rights is available in our Privacy Policy.
We do not intentionally make private account information or privately saved application data publicly available to advertisers. Advertising displayed on our website may nevertheless be selected or measured using advertising technologies and settings provided by Google.
10. Contact Forms and Communications
If you contact us through a website form or email, we may process the information you provide to respond to your inquiry, provide support, manage complaints, and maintain appropriate records.
Please do not submit passwords, payment card details, or unnecessary sensitive information through our contact form.
Our processing of contact information is explained in our Privacy Policy.
11. Newsletter Subscriptions
You may choose to subscribe to the Aqyanoos newsletter to receive educational content, updates, announcements, or other communications described when you subscribe.
You can unsubscribe at any time using our unsubscribe page: Unsubscribe from the Aqyanoos newsletter. You may also contact us for assistance.
Unsubscribing stops future newsletter communications covered by that subscription. It does not automatically delete your Aqyanoos account or information processed for other purposes.
Newsletter subscription information is handled in accordance with our Privacy Policy.
12. Purchases, Paid Services, and Subscriptions
Some products or services may be free, while others may require payment, a subscription, or another form of purchase. Applicable prices, billing frequency, features, duration, and cancellation conditions will be presented for the relevant product where applicable.
Payments may be processed by Aqyanoos or through an app store, payment processor, or other third-party provider. Those providers may apply their own terms, payment procedures, and refund processes.
Applicable renewal, cancellation, refund, withdrawal, and digital-content rules will be disclosed as required by law. Nothing in these Terms removes mandatory consumer rights, including rights applicable to digital content and digital services in the European Union.
Where a purchase involves a statutory withdrawal right, any exception or early commencement of performance will apply only where the applicable legal requirements and required consent or acknowledgment have been satisfied.
If no paid product or subscription is offered, this section applies only if such functionality is introduced in the future.
13. Third-Party Services and Links
Our services may refer to or link to third-party websites, software, libraries, app stores, advertising platforms, or other resources. Third-party services are generally governed by their own terms and privacy policies.
We do not control independent third-party services and are not responsible for their independent acts or omissions, except where applicable law provides otherwise.
The inclusion of a link or reference does not necessarily imply that Aqyanoos endorses the third party or guarantees the quality, accuracy, availability, or security of its services.
14. Service Availability and Changes
We aim to provide reliable services, but we do not guarantee uninterrupted or error-free availability. Services may occasionally be unavailable because of maintenance, updates, technical failures, security incidents, or circumstances outside our reasonable control.
We may modify or discontinue features for legitimate operational, technical, legal, or security reasons, subject to applicable contractual obligations and mandatory consumer protections.
15. Disclaimer of Warranties
To the extent permitted by applicable law, services and content are provided on an "as available" basis, subject to any express warranties or statutory rights that apply.
We do not warrant that every service will be uninterrupted, completely secure, compatible with every device, free of all defects, or suitable for every purpose.
Nothing in these Terms excludes or limits any warranty, statutory guarantee, consumer right, or other protection that cannot lawfully be excluded or limited.
16. Limitation of Liability
To the extent permitted by applicable law, Aqyanoos shall not be liable for indirect or consequential losses that are not reasonably foreseeable and arise from the use of our services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including mandatory liability for intentional misconduct, fraud, or other liability that cannot legally be excluded.
If you use our services as a consumer, your statutory rights and mandatory remedies under applicable consumer protection law remain unaffected.
Where permitted by law, we are not responsible for losses caused by misuse of our services, failure to follow reasonable instructions, incompatible systems, unauthorized modifications, or independent third-party services beyond our reasonable control.
17. Indemnification
To the extent permitted by applicable law, you may be responsible for losses or reasonable costs directly arising from your unlawful use of our services, infringement of another person's rights, or material violation of these Terms.
This section does not impose liability where prohibited by law or override mandatory consumer protections.
18. Account Deletion and Termination
You may stop using our services at any time. Registered users can delete their accounts and remove their associated personal data through the account deletion functionality on their profile page.
If you cannot access your account or need assistance, you may request account and data deletion by contacting us at: contact@aqyanoos.com. We may need to verify your identity before processing the request.
We will handle account deletion in accordance with our Privacy Policy and applicable law. Information will be deleted or anonymized as appropriate, except where it must or may lawfully be retained.
Deletion may take a reasonable amount of time to complete across active systems and backups. Certain information may remain temporarily in backups or be retained where required for legal compliance, security, or the establishment or defense of legal claims.
Deleting an Aqyanoos account does not automatically delete information held independently by third-party services, including Google Analytics, Google Ads, an email provider, or an app store.
We may suspend or terminate access where reasonably necessary due to a serious breach of these Terms, unlawful activity, security risks, abuse, or legal requirements. Where appropriate and legally permitted, we will provide notice and an opportunity to remedy the issue.
Provisions that by their nature should survive termination, including applicable intellectual property rights, accrued payment obligations, and lawful liability provisions, will continue to apply to the extent permitted by law.
19. Privacy
Our Privacy Policy explains how we process account and profile information, saved application data, contact form submissions, newsletter subscriptions, analytics information, advertising-related information, and other personal information.
By using features that involve personal information, you acknowledge that the relevant processing is described in our Privacy Policy. Where consent is legally required, this acknowledgment does not replace the need to obtain valid consent.
20. Changes to These Terms
We may update these Terms to reflect changes in our services, business practices, or legal obligations.
The latest version will be published on this page with an updated effective date. Where required by law, we will provide notice of material changes or obtain any required agreement before those changes take effect.
If you do not agree to revised Terms, you should stop using the affected service, subject to any applicable contractual rights and obligations.
21. Governing Law and Disputes
These Terms are governed by the laws of Belgium, subject to applicable conflict-of-law rules and mandatory legal protections that apply in your country of residence.
If you are a consumer residing in another country, nothing in this section deprives you of protections that cannot lawfully be excluded by agreement, including mandatory consumer protection rules that apply to you.
If a dispute arises, we encourage you to contact us first so that we can attempt to resolve the matter informally. This does not restrict your right to bring a claim before a court or authority that has jurisdiction under applicable law.
22. Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
23. No Waiver
A failure or delay by Aqyanoos in exercising a right under these Terms does not constitute a waiver of that right, except where applicable law provides otherwise.
24. Entire Agreement
These Terms, together with applicable product-specific terms, purchase conditions, and policies expressly incorporated into them, govern your use of the relevant services.
They do not override any separate agreement that expressly applies to a particular service or any mandatory legal rights that cannot be excluded by agreement.
